H.R. 3991:  Emergency Influenza Containment Act

Summary

The Emergency Influenza Containment Act would require employers to provide an employee with up to five days of paid sick leave per 12-month period if, during that period, the employer directs the employee to leave work or not to come to work because the employer believes the employee has symptoms of a contagious disease or has been in contact with a symptomatic individual.  The Act would apply to employers of 15 or more employees.  Employers that already provide at least five days of paid sick leave in a 12-month period, which may be used at the employee’s discretion, are exempt.  The bill includes a sunset provision that provides that the Act will expire within two years of enactment.
