Summary
The Family and Medical Leave Restoration Act, introduced in the House of Representatives on April 29, 2009 by Rep. Carol Shea-Porter, would require the Secretary of Labor to repeal and revise certain Family and Medical Leave Act (“FMLA”) regulations implemented in November 2008. For example, the bill would reverse limitations on the use of accrued paid leave while an employee is on FMLA leave. The bill would also restore the prohibition on denying attendance bonuses as a result of taking FMLA leave and restore protections that prohibit an employer from approving or denying FMLA leave requests based on noncompliance with employer leave request policies. The bill would further require the Secretary of Labor to revise the regulations regarding recertification of a medical condition.
Current Status: The bill has been referred to the House Committees on Education and Labor, Oversight and Government Reform, and House Administration.
