Prof. Epstein on EFCA: "'Cure' to a Non-Existent Problem"

Professor Richard Epstein has a concise and thoughtful opinion piece in today's New York Post entitled "A Labor Dilemma for President Bam."  While Senator McCain (R-AZ) chose not to cite the hypocrisy of EFCA in response to Senator Obama's (D-IL) debate proclamations that he is intent upon creating jobs, Professor Epstein is not as deferential:

THE financial crisis has unfortunately deflected attention from our
next major meltdown: ordinary labor markets. The early days of an Obama
administration will likely see passage of othe so-called Employer Free Choice
Act - which will put a union noose around the neck of every US business, large
and small. 

The Professor points out the "false diagnosis" being peddled widely by organized labor, and suggests that EFCA is the intended "two-part 'cure'" to a "non-existent problem."  We note only that EFCA is actually intended to be a "three-part" cure to, at best, a vastly overstated problem.  As we have pointed out repeatedly, EFCA will not only eliminate secret ballots for employees, and subject employers to mandatory interest arbitration, but will also unnecessarily add a wide range of new punitive remedies against employers only.
