Summary

The Protecting Older Workers Against Discrimination Act, introduced on October 6, 2009 in the House of Representatives by Rep. George Miller would amend the Age Discrimination in Employment Act of 1967 (“ADEA”) by clarifying that a plaintiff may establish an unlawful employment practice under the ADEA by demonstrating that an impermissible factor was a “motivating factor” for the practice.  The bill has been referred to the House Committees on Education and Labor and Judiciary.
