Summary

The Truth in Employment Act of 2009 would amend the National Labor Relations Act by allowing employers to refuse to employ individuals who are seeking or have sought employment for reasons other than a desire to work for the employer, such as to organize the employer's workforce.  The bill's purpose is to “alleviate pressure on employers to hire individuals who seek or gain employment in order to disrupt the workplace of the employer or otherwise inflict economic harm designed to put the employer out of business.”  Such tactics are commonly referred to as “salting” and involve “salts” seeking employment at a nonunion workplace for the purpose of organizing the workplace.

Current Status:  The bill has been referred to the House Committee on Education and Labor and the Senate Committee on Health, Education, Labor, and Pensions.
